Participation Waiver and Release of Liability
Second Studio, a dance company in Ottawa, Ontario, has organized regular zouk classes and zouk weekend events, hereby referred to as the “Program”.
You may only participate in the Program if you accept that there are risks to the Program that will be your sole responsibility. This document (the “Agreement”) is a legal waiver. By signing this waiver, you recognize that you will assume certain physical and legal risks in participating in the Program, and that Second Studio, and its proprietor, successors and permitted assigns will not be held legally responsible for those risks or any loss whatsoever occasioned by those risks.
Acknowledgment of Risk and Waiver of Liability
I recognize and understand my participation in the projects, events, and activities of the Program has inherent risks, including the potential loss of personal property and the risk of physical injury or death which might result not only from my own action, inaction or negligence, but also the actions, inaction or negligence of others. Knowing the risks and dangers involved, I desire to attend and participate in the Program.
In consideration of my participation in the Program I hereby waive the right to any legal claim or proceeding and further release, hold harmless, and forever discharge Second Studio and its proprietor, heirs, executors, agents, employees, and assigns, from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any illness or injury to person or property, including injury resulting in death, which has been or may be sustained in the course of, or directly as a result of, attending and participating in the Program, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of Second Studio or its proprietor, employees, customers, or clients.
I represent that I am physically and mentally capable of safely and responsibly participating in the Program.
I acknowledge that if, while participating in the Program, I engage in any behavior that threatens the health or safety of any person, or violates any law of Canada or Ontario, or violate the Second Studio Code of Conduct, Second Studio, or its proprietor or employees, may in their sole and absolute discretion, terminate my participation in the Program without refund for the cost of the Program. Any additional costs incurred by reason of the termination of my participation in the program will be my responsibility.
I further agree to indemnify and save and hold harmless Second Studio and the other participants from any loss, liability, damage or costs whatsoever that they may incur due to my involvement as a Participant, whether caused by the negligence of any or all the named parties in this Agreement, or otherwise.
This waiver shall be governed by Ontario law and the laws of Canada applicable therein, excluding its conflict of law provisions.
I HAVE READ AND UNDERSTAND THIS DOCUMENT AND I AM AWARE THAT BY SIGNING THIS ASSUMPTION AND ACKNOWLEDGMENT OF RISK I SURRENDER CERTAIN LEGAL RIGHTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND I SIGN THIS DIGITAL DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT. I UNDERSTAND THAT I HAD THE OPPORTUNITY TO ASK FOR CLARIFICATION FROM SECOND STUDIO OR MY OWN LEGAL COUNSEL.
Photography/Videography Policy and Release
Second Studio and its staff, as well as other Participants, may take photographs and videos (the “Media”) of Participants during the Program’s events. By signing below, you agree to grant Second Studio permission to use the Media for promotional purposes. Second Studio may post the Media to Second Studio’s website, as well as popular social media websites including, but not limited to, Facebook, Instagram, Pinterest, and Twitter. Second Studio may also include the Media in physical and digital promotional materials that she publishes from time to time.
By participating in the Program you agree to grant Second Studio and its heirs, and assigns an unrestricted licence to use and publish any Media of the Participant that was taken during the Program, and to alter and distribute the Media for promotional purposes to further the objectives of Second Studio Ottawa and the Program. If you would like to withdraw your consent at any time, please contact us at info@secondstudio.ca.
Ticket Changes, Transfers and Refunds Policy
Tickets are non-refundable, but are fully transferrable until 7 days prior to the commencement of the Program. All transfers must be for the same role (for example, lead or follow). No transfer is confirmed until the transferer/transferee receives written confirmation from the event organizers. A $20 CAD transfer fee applies. Ticket changes are permitted without a fee within 48 hours of purchase. Ticket transfer requests, even without 48 hours of purchase, is considered a transfer, not a change.
Substance and Alcohol Policy
Second Studio does not sell or permit alcohol or drugs in our events. No smoking, vaping, or incense of any kind is permitted in our venue. Any alcohol or legal recreational drugs will be confiscated by the venue or event staff if found, or you will be asked to leave and not return with those items. While marijuana is legal, no marijuana is permitted in the venue, and Ontario law forbids driving under the influence of marijuana and other drugs.
No selling of any drugs, including marijuana, may take place on event premises. No illegal substances of any kind are permitted. If found, you will be banned from the event without refund.
Second Studio reserves the right to remove any individual who, in our opinion, is too intoxicated to participate responsibly in the event.
Public Health Measures During the COVID19 Pandemic
As social dancing is a high-contact activity, participants are required to be fully-vaccinated, defined as having received the second dose of a two-dose Health Canada approved vaccine, more than two weeks ago. Participants agree to wear a mask covering the nose and mouth at all times during the course and socials. Participants agree to complete symptom screening prior to each and every class and social.
